Terms of Service

By accessing or using the Service, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a company, you represent that you have the authority to bind that company to these Terms.

The Service is offered under three subscription plans: Individual ($39/month), Pro ($129/month), and Business ($249/month). All plans include a 14-day free trial; no charge is applied during the trial period.

After the trial, your selected plan is billed monthly in advance via our payment processor (Base44 Payments / Wix). You authorize us to charge the recurring subscription fee until you cancel. You may cancel at any time from your account; cancellation takes effect at the end of the current billing cycle and you retain access until then.

Plan limits apply as follows: Individual includes up to 15 roof reports per month and 1 user; Pro includes up to 60 reports per month and up to 5 team members; Business includes up to 200 reports per month and up to 15 team members. Reports created beyond your plan's monthly limit are charged at $3.00 per report. Extra team seats beyond your plan's limit (Business plan only) are charged at $10.00 per seat per month.

Each new account receives a 14-day free trial. You will not be charged during the trial. At the end of the trial period, your subscription begins automatically and your payment method is charged the plan fee. You may cancel before the trial ends to avoid being charged.

Subscription fees are non-refundable except where required by law. If you cancel, you will not be charged for the next billing cycle, but you will not receive a refund for the current cycle. Overage report charges ($3.00 per report) and extra seat charges ($10.00 per seat per month) are also non-refundable once incurred.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any local, state, national, or international law.
• Share your account credentials or allow unauthorized users to access the Service.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service to generate fraudulent or misleading estimates, contracts, or reports.
• Scrape, copy, or redistribute satellite imagery or measurement data in violation of applicable licensing terms.
• Interfere with or disrupt the Service's servers, security, or functionality.

This section is important. Please read it carefully.

MeasureShark generates roof measurements and area calculations using satellite imagery and user-drawn outlines. These measurements are estimates based on available satellite imagery and are not certified architectural surveys, engineering drawings, or on-site physical measurements.

Satellite imagery may be outdated, obscured by weather or tree cover, or limited in resolution. Measurements derived from such imagery may differ from actual on-roof dimensions. You are solely responsible for verifying all measurements before ordering materials, submitting bids, signing contracts, or performing construction work.

MeasureShark, its officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or financial damages arising from the use of or reliance on measurements, estimates, reports, or other data generated by the Service, including but not limited to material overages or shortages, incorrect bids, lost contracts, or construction errors.

You acknowledge that the Service is a tool to assist your estimating process and does not replace the professional judgment of a licensed contractor, architect, or engineer. You assume all risk associated with the use of measurement data produced by the Service.

The Service includes tools to generate contracts and proposals. Contract templates provided by MeasureShark are general templates and do not constitute legal advice. You are responsible for reviewing and, if necessary, having an attorney review any contract before signing. MeasureShark is not a party to any contract between you and your client and bears no responsibility for the terms, enforceability, or outcome of any contract created using the Service.

You retain ownership of any content you upload or create using the Service, including property addresses, client information, pricing data, and roof reports. You grant us a limited license to host, store, and process your content solely to provide the Service to you. You are responsible for ensuring you have the right to use any client information you enter into the Service and for complying with applicable privacy laws regarding that information.

The Service, including its design, software, features, and branding, is owned by MeasureShark and protected by intellectual property laws. These Terms do not grant you any right to use the MeasureShark name, logo, or trademarks without our prior written consent.

To the maximum extent permitted by law, MeasureShark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of or inability to use the Service. Our total aggregate liability for any claim arising from the Service shall not exceed the amount you paid us in the three (3) months preceding the claim.

We strive to maintain high availability but do not guarantee that the Service will be uninterrupted, error-free, or secure. We may modify, suspend, or discontinue the Service or any feature at any time. We are not liable for any downtime, data loss, or interruption of service.

You may cancel your account at any time. We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or if we determine that your use of the Service poses a risk to us or other users. Upon termination, your access to the Service ends immediately. We may retain your data for a reasonable period after termination as described in our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which MeasureShark is incorporated, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
